Short answer: In Georgia, as in most states, a money judgment can usually be sold by assigning it to a buyer. Before you sell, check how much enforceable life the judgment has left, how interest accrues, and how the assignment is recorded. Facts below are marked verified only where we checked an official source.

How long does a judgment last, and can it be renewed?

A judgment becomes dormant and unenforceable if 7 years pass without execution being issued and entered on the general execution docket, or without the other qualifying docket entries. Each qualifying entry starts a new 7-year period (O.C.G.A. § 9-12-60).

What is the post-judgment interest rate?

Judgments bear annual interest at the prime rate published by the Federal Reserve (H.15) on the day the judgment is entered, plus 3%. If the judgment is on a written contract that sets a rate, the contract rate applies. Interest applies automatically (O.C.G.A. § 7-4-12).

How do you file an assignment of judgment?

A judgment holder may, in good faith and for valuable consideration, transfer a judgment to a third person. The transferee gets the same rights, and is subject to the same equities and defenses, as the original holder (O.C.G.A. § 9-12-21; transfer of an execution: § 9-13-34). Record the transfer with the clerk of the court that entered the judgment.
