Sell a court judgment in Illinois

Last updated:

Short answer: In Illinois, as in most states, a money judgment can usually be sold by assigning it to a buyer. Before you sell, check how much enforceable life the judgment has left, how interest accrues, and how the assignment is recorded. Facts below are marked verified only where we checked an official source.

How long does a judgment last, and can it be renewed?

A judgment can't be enforced after 7 years unless it is revived (735 ILCS 5/12-108). Revival is by petition, generally within 20 years of entry; consumer-debt judgments have special rules (735 ILCS 5/2-1602).

What is the post-judgment interest rate?

Judgments draw 9% a year (6% against government entities). Consumer-debt judgments of $25,000 or less draw 5% (735 ILCS 5/2-1303).

How do you file an assignment of judgment?

Not verified. We did not find an Illinois statute or statewide court form that sets out how an assignment of judgment is filed. In practice, assignees commonly file a signed, notarized assignment of judgment with the clerk of the court that entered the judgment, but procedure varies by court. Confirm with that clerk or counsel.

Do judgment buyers and collectors need a license?

Collection agencies need a license under the Collection Agency Act, now 205 ILCS 740 (formerly 225 ILCS 425). Debt buyers are covered but exempt from some requirements, such as the bond and trust account (§ 8.6).
