Sell a court judgment in Tennessee

Last updated:

Short answer: In Tennessee, as in most states, a money judgment can usually be sold by assigning it to a buyer. Before you sell, check how much enforceable life the judgment has left, how interest accrues, and how the assignment is recorded. Facts below are marked verified only where we checked an official source.

How long does a judgment last, and can it be renewed?

Actions on judgments and decrees of courts of record must be brought within 10 years (Tenn. Code Ann. § 28-3-110(a)(2)); renewal must happen within that period.

What is the post-judgment interest rate?

The judgment rate is 2% below the formula rate published by the commissioner of financial institutions, set for each half-year (June rate for July-December judgments, December rate for January-June). The Administrative Office of the Courts publishes the current rate. A contract rate within legal limits applies instead if the judgment is based on a writing that fixes one (Tenn. Code Ann. § 47-14-121).

How do you file an assignment of judgment?

Not verified. We did not find an Tennessee statute or statewide court form that sets out how an assignment of judgment is filed. In practice, assignees commonly file a signed, notarized assignment of judgment with the clerk of the court that entered the judgment, but procedure varies by court. Confirm with that clerk or counsel.

Do judgment buyers and collectors need a license?

No one may operate a collection service business in Tennessee without a license from the Collection Service Board (Tenn. Code Ann. § 62-20-105(a)). The same section says the Act does not prevent anyone from purchasing, selling, assigning or taking assignment of an obligation (§ 62-20-105(d)).
